Stella Passage consent enters court challenge
Port of Tauranga’s Stella Passage development has moved from regulatory approval into a legal contest, after tangata whenua parties appealed the consent and filed an application for judicial review.
The consent was issued on 7 September under the Fast-track Approvals Act. Port of Tauranga (NZX:POT) said it had been notified of both proceedings, but did not disclose the grounds of the appeal, the identity of the parties involved or the remedies being sought.
Port seeks earliest possible hearing
Chief executive Leonard Sampson described the appeals as disappointing but not unexpected. “The urgency of this project is unchanged, and we will be seeking the earliest possible court hearing,” he said.
That response signals an attempt to keep the project moving while the consent’s legal status is tested. It does not, however, establish when a hearing will occur or whether the proceedings will alter the approved development, its timing or its cost.
The announcement contains no estimate of the financial consequences and does not say that the consent has been revoked or suspended.
