FDA Accepts Supervisory Review Request

Echo IQ Limited (ASX:EIQ) has opened an administrative appeal against the US Food and Drug Administration’s rejection of the standard 510(k) pathway for EchoSolv HF, with the regulator accepting the company’s request for supervisory review.

The FDA’s ombudsman has also been informed, and Echo IQ expects to meet the regulator within the next 30 days. The company said that meeting should provide greater clarity on the product’s regulatory pathway, though it has not said the determination has been overturned or that clearance is now assured.

Not Substantially Equivalent Decision Still Stands

The appeal follows September regulatory options, when Echo IQ said it was weighing an appeal, an Ombudsman review or a fresh 510(k) submission after receiving the Not Substantially Equivalent determination. The latest filing confirms the appeal route has been selected and accepted, narrowing the immediate focus to the FDA meeting.

For shareholders, the distinction matters. Acceptance of a supervisory review is a procedural step, not a regulatory approval. Echo IQ’s announcement does not disclose the FDA’s reasons for accepting the appeal, the evidence to be considered, or whether a successful review could lead directly to clearance or require another submission.

FDA Meeting Becomes the Next Catalyst

The meeting is expected within 30 days, after which Echo IQ says it will provide further updates as developments in the regulatory pathway emerge. Until then, EchoSolv HF remains caught between the company’s appeal and the FDA’s existing determination, leaving the timing and commercial implications unresolved.

Bottom Line?

The appeal gives Echo IQ a defined regulatory process, but the key test is whether the FDA meeting produces a revised pathway rather than simply more guidance.

Questions in the middle?

  • Will the FDA meeting lead to reconsideration of the Not Substantially Equivalent determination?
  • Could EchoSolv HF require a new 510(k) submission even if the supervisory review progresses?
  • How quickly will Echo IQ receive and communicate a definitive regulatory pathway after the meeting?
