37 years without production as Bougainville Copper reviews EL01 position

Mining By Maxwell Dee 3 min read

Bougainville Copper remains without production more than 37 years after Panguna operations stopped, while its independent board committee weighs the implications of a rival 25-year mining lease over EL01. Further legal advice and a December committee meeting are now the next key markers.

  • No production since 15 May 1989
  • Independent Board Committee reviewing EL01 legal and strategic implications
  • Further legal advice being obtained ahead of a December meeting
  • Separate National Court proceedings by landowner groups being monitored
  • Panguna remediation and community infrastructure work continues

EL01 Rights Review Moves Towards December

Bougainville Copper Limited (ASX:BOC) remains a non-producing company, reporting no production since 15 May 1989, but its latest quarterly update keeps the focus firmly on the contested future of the Panguna project. The company says its Independent Board Committee is assessing the legal, governance and strategic implications of the Autonomous Bougainville Government’s grant of a 25-year large-scale mining lease over EL01 to Bougainville Minerals Limited.

The lease grant was followed by the suspension and subordination of Bougainville Copper’s right under EL01. The company’s committee delivered recommendations in September, but Bougainville Copper is obtaining further legal advice before determining potential next steps. The committee is scheduled to meet again in December.

The development extends the uncertainty described in the company’s half-year EL01 rights update, which reported that the exploration licence rights had been suspended and subordinated to the new mining lease. Bougainville Copper is also monitoring separate National Court proceedings brought by landowner groups, although the quarterly announcement does not provide details on the claims, timetable or possible outcomes.

Panguna Remediation Work Continues

Alongside the legal review, Bougainville Copper continues to assist with priority remediation projects identified through the Panguna Mine Legacy Impact Assessment. The company said a newly constructed chapel had been handed over to the Jaba River Catholic Church sub-parish, replacing an unstable industrial structure that had previously served as a pump station during the mine’s operation.

Other work includes the ongoing removal of hazardous materials at Loloho Port and levee isolation monitoring. Concrete wall removal in Panguna township and drainage clean-up along the Port Mine Access Road have been completed, while construction of a pedestrian footbridge at Kuneka Creek is due to begin shortly.

The filing gives no estimate of remediation costs, potential liabilities or any financial effect from the EL01 dispute. For shareholders, the December committee meeting and the company’s further legal advice are therefore more immediate markers than any production milestone: the quarterly report contains no indication that mining has resumed or that a pathway to production has been established.

Bottom Line?

The December committee meeting may clarify Bougainville Copper’s next legal and strategic step, but the filing leaves the company’s EL01 position, remediation burden and route to any future production unresolved.

Questions in the middle?

  • What legal or strategic recommendations will the Independent Board Committee adopt in December?
  • Will further legal advice change Bougainville Copper’s position regarding its suspended and subordinated EL01 rights?
  • What costs, liabilities or funding requirements will emerge from the ongoing Panguna remediation work?
